Trial date set in game case

By Mike Marino
Cibola County Bureau

GRANTS ? Even legendary big game hunters and guides can be brought down by the full weight of the American legal system when they are convicted of breaking the law.

The case of Kirt Darner and his wife, Paula D. Darner, could provide a good example of that.

Some of the charges lodged against Darner, who was 66 at the time of the original indictment, are two counts each of transporting stolen livestock, receiving stolen property, conspiracy to transport stolen livestock and tampering with evidence. His wife, 49 at the time of her indictment, was charged with six felony and 13 misdemeanor charges.

The Darners' trial is expected to begin on April 23, 2007. Darner, if convicted of all charges could face maximum penalties of up to 33 years in prison on nine felony counts, while his wife, if convicted, could face up to 24 years in prison on six felony counts.

In February 2006, the grand jury indicted Darner for illegally drugging and moving up to four wild elk, three of them state-owned, on a 40-acre Lobo Canyon ranch to Pancho Peaks Ranch and Game Park, owned by Steve W. Lewis of Artesia in 2004. Lewis was indicted on two felony counts of conspiracy involving controlled substances to sedate a large bull elk for transportation.

Darner is from Crawford, Colo., and is best known as a noted trophy mule deer hunter, hunting guide and author of numerous trophy hunting books. Darner was also the subject of numerous articles and interviews in outdoor and hunting magazines, including many features on his life and career in "Outdoor Life."

Darner also claimed at one point in his long career that he had brought down more Boone and Crockett trophy deer than anyone else in the books; however, that claim was challenged, and in anger and protest, Darner removed all his claims from the Boone and Crockett record books.

Darner is no stranger to law enforcement. Once the advertising face for Remington bolt action rifles in the '70s and '80s, had his license revoked by wildlife authorities in Colorado for three years in 2001 after it was discovered that a hunter Darner was guiding shot illegally at an elk decoy from the window of a truck. The hunter Darner was guiding at the time also did not possess a permit for that particular hunt unit.

I don't know about these charges necessarily, but those people who are/were close to Darner in his "heyday" knew how crooked he really was. I talked personally to a couple of guys who did the research and found him to be a habitual law-breaker. This doesn't really surprise me at all.

Well according to Bobcatbess Darner is no different than a person going over the speed limit.

ACCORDING TO JULIUS & ALL THE OTHER MM ANGELS THEY HAVE NEVER DONE ANY WRONG IN THERE ENTIRE LIVES!!!

I MADE AN EXAMPLE TRYING TO GET IT THROUGH ALL THE MM ANGELS THICK HEADS THAT WE ALL BREAK LAWS OF SOME TYPE!!!

I NEVER SAID ANY OF IT WAS O.K.!!!

SOMEBODY SAID:IF I WAS BREAKING THE SPEED LIMIT & EVEN THOUGH IT WASN'T MY FAULT BUT GOT INTO A WRECK & I HURT/KILLED SOMEBODY I'D BE WORSE THAN DARNER!!!

WAKE TF UP JULIUS!!!

ALL YOU'RE TRYING TO DO IS STIR IT!!!

THE ONLY bobcat WITH A KIRT DARNER BOOK IN MINT CONDITION FOR SALE!!!

I've got 20 bucks in my pocket that says the Darners will be exonerated! Any takers?

There is a big difference from committing a felony and a moving violation. You just think your oppinion is the only one that is important. I pride myself on being a law abiding citizen. There is no gray area when it comes to breaking the law. You wake TF up and keep your two cents to yourself. I just get tired of reading your negative attitude in everthing you post.

Julius

WELL!!!

julius IS CLAIMING TO BE ONE OF THE ELITE ANGELS!!!

THATS YOUR OPPINION!!!

SOME CLAIM DIFFERENT!!!

ITS ALL WRONG!!!

BUT I'LL BET IF WE COULD PUT YOU ON A POLYGRAPH FOR 5 MINUTES WE'D FIND THAT THERES PROBABLY A FEW TIMES IN YOUR LIFE WHEN YOU'VE BENT THE RULES!!!

I MIGHT BE WRONG THOUGH???

EVERYTIME I CLAIM WE ARE ALL SINNERS/HYPOCRITS HERE COME THE MM ANGELS TO PROVE ME WRONG!!!

PLEASE DON'T READ ANYMORE OF MY POSTS!!!

THE ONLY bobcat!!! }> }> }> }> }> }> }>

Bobcat your logic, if you want to call it that , is severely flawed or is the result of some underlying immoral premise. So according to you someone who has a moving violation should not be critical of someone else who has broken the law because we are all sinners. So because I admit from time to time I have exceeded the speed limit, I am not allowed to pass judgementor express a critical opinion about lets say an admitted serial killer. Afterall I would not want to appear to be a MM angel by expressing displeasure with a fellow lay breaker. Your failure to recognize that there is a difference between a moving violation and other criminal conduct is astonishing.

caelkhnter!!!

YOU STILL DON'T GET IT!!!

NEVER SAID THERE WASN'T A DIFFERENCE!!!

DIFFERENT PEOPLE LOOK AT DIFFERENT LAW BREAKING IN MANY DIFFERENT WAYS!!!

SOME MAY NOT THINK MY SPEEDING HABIT IS ALL THAT BAD!!!

OTHERS THINK I'M GOING TO HELL FOR IT!!!

THERE ARE MAJOR DIFFERENCES!!!

BUT THAT DEPENDS ON WHO'S JUDGING WHO!!!

WE ARE ALL SINNERS/HYPOCRITS!!!

WELL,MOST OF US ARE!!!

I'LL EXCLUDE THE MM ANGELS!!!

I GUESS YOU MISS THE HYPOCRIT THREAD HUH???

THE ONLY bobcat!!! }> }> }> }> }>

Bobcat it is you that is missing the point. YOu say yes there are major differences but then go on to say it depends on who is passing judgement. Specifically you state:

THERE ARE MAJOR DIFFERENCES!!!

BUT THAT DEPENDS ON WHO'S JUDGING WHO!!!

That statement makes my point, you seem to be saying that because we are all sinners we should not judge others' sins. Ridiculous! Yes I have sinned, I have driven faster than the posted speed limit. However just because I have done so does not mean I should not be able to condem those that engage in serious criminal conduct. I do not think it means I am a hypocrit simply because I am will to pass judgement on other major criminals.

caelkhntr!!!

SO!!!

BASICALLY YOU'RE SAYING ITS O.K. TO BREAK THE LAW A LITTLE BIT!!!

BUT DON'T BREAK IT ALL THE WAY!!!

WTF???

NOW IF YOU WERE DRIVING FASTER THAN THE SPEED LIMIT (SPEEDING) AND YOU WERE INVOLVED IN AN ACCIDENT THAT HURT/KILLED SOMEBODY DOES THAT MAKE YOU ANY DIFFERENT???

I'M ONLY ASKING CUZZ SOMEBODY ASKED ME THE SAME QUESTION!!!

MOST PEOPLE DIDN'T MIND THE FACT THAT I DO SPEED!!!

AS LONG AS I NEVER ENDANGERED THEIR FAMILY WHILE DOING IT!!!

KINDA LIKE A FEW MENTIONED ON OTHER HEATED THREADS!!!

SOME SAID THEY WOULDN'T OF MINDED A DEER BEING POACHED AS LONG AS IT WAS A SMALL NON TROPHY TYPE ANIMAL!!!

SOME SAID IT WOULDN'T OF BOTHERED THEM IF IT HAD OF BEEN A ONE TIME ORDEAL!!!

SOME SAID IT WOULD OF BEEN TOLLERABLE ONCE,BUT MOST SAID WHEN IT BECAME MULTIPLE THEY WOULDN'T TOLLERATE IT!!!

WTF???

BREAKING THE LAW ONCE IS O.K. BUT DON'T DO IT TWICE???

JUST TRYING TO SPLAIN SOME OF WHATS ALREADY BEEN SAID!!!

I COULD GO ON & ON & ON & ON & ON BUT I WON'T!!!

ONE OF OUR EX-ATTORNEYS JUST GOT ARRESTED FOR DUI,DOES IT MAKE IT RIGHT SHE THROWED THE BOOK AT OTHER PEOPLE WHILE SHE WAS AN ATTORNEY FOR POSSIBLY BREAKING THE SAME LAW WHILE PROSECUTING OTHERS???

THE ONLY bobcat!!!

No Bobcat I am not saying it is okay to break the law a little bit. I am saying that it does not make someone a hypocrit if they have had minor moving violations and they condem someone who has engaged in serious criminal conduct.

The important thing to remember, which you already have acknowledged, is that crimes are not all the same. The level of culpability matters. For example if you are speeding on the highway, and have no intent to harm someone and have no reason to think that you are endangering anyone, but unfortunately loose control and kill someone, then yes you can and probably will be prosecuted for vehicular manslaughter. Again you did not have an intent to kill but you did so and should be held responsible. Compare that to someone who commits first degree premedatated murder. That person actually had the intent to kill someone. Even if you broke the law by speeding it is okay to pass judgement and condem the murderer for his more serious crime. It is not hypocrtical to do so.

Finally the DA who was caught DUI. I say through the book at her. I believe in zero tolerance for drunk drivers. I do not care who the guilty person is. I do not care if she was a great DA. She should know better and should not get a free pass.
