Court rules hunter competent

GRANTS - Big game hunter Kirt L. Darner appeared before Judge Camille Martinez Olguin Friday morning and was found competent to stand trial on June 23.

Darner's earlier trial date was postponed when the judge dismissed the juror pool because she was informed that the accused was taking a prescribed medication that make him unable to assist in his defense.

Defense Attorney Billy Blackburn has filed six motions with the Thirteenth Judicial District Court. Three of those motions will be heard May 9 and the remainder will be heard on May 29 and 30.

In February of 2006, Darner was charged by the Thirteenth Judicial Grand Jury with two counts of receiving stolen property (more than $20,000), two counts of conspiracy to transport stolen livestock, three counts of tampering with evidence, two counts of transportation of stolen livestock (live bull elk), two counts of unlawful possession of big game (live bull elk), four counts of failure to submit an invoice for sale of game (live bull elk), failure to maintain minimum aggregate number of game (live bull elk) and four counts of failure to have two forms of identification and health certificates for the animals. The events surrounding the charges occurred between May 20, 2000, and Feb. 25 of 2005. Darner is charged with nine felonies. His attorney has filed a motion to exclude the felony charges.

Kirt's wife, Paula Darner, faces similar charges. They have both entered pleas of not guilty with the court and will be tried separately.

?We are ready to go to trial, we have been ready but all the delays have prevented us from getting to trial,? said District Attorney Lemuel Martinez. As for the motions filed Martinez added that the defense has filed standard motions on behalf of their client.

At the time of the charges the Darners owned and operated a 40-acre Lobo Canyon hunting ranch north of Grants.

According to a report, officers with the New Mexico Department of Game and Fish conducted a search of the Darner's home and vehicles in Feb. 2005. During that search the skull of a Rocky Mountain bighorn sheep and a Desert bighorn sheep were found in one of Darner's vehicles.

After a brief discussion Deputy District Attorney Randolph Collins and Blackburn informed the judge that the trial would take seven working days.
 
WOW. He's perhaps the most well-known and talked about muley hunter of all time. Long story and too much for me to write here. Really lots of controversy and problems.

Thanks for the update. I have been wondering what had happened to the trial. Keep us posted as it unfolds.

i remember years and years ago when all my hunting buddies , self included, wanted to be as good as Darner.

I still do! He knows how to hunt! I think even a 230 inch buck would be hard to poach!

I remember when I was a kid I wanted to be as good a baseball player as Barry Bonds and Mark McGwire and Roger Clemens. Hmmm - guess I was deceived too!

Darner is nothing but a name now and has crossed the line and may not be able to get himself out of this predicament.

Hey, that was 30 years or so ago, long before all the stories of his poaching came out. How were we supposed to know then that the guy was going to prove out to be a less than a respectful, highly succesful, but dishonest trophy Mulie hunter? We then thought his big bucks came legit.
 
Kirt wrote the book "How To Find Giant Bucks", but he left out the chapter that covers garage sales and flea markets.

Apparently someone doesn't spend much time on the winter range anywhere near a true trophy unit. You see, generally, poachers are lazy. They don't get out and hike for their trophies, they take the easy route. You know the story; 6 feet of snow on the winter range, after the season, with a spotlight in a hayfield.

Darner is a POACHER!!! NOT a good hunter. Give me a break.

Darner was a hell of a hunter.I dont think he is any different than Barry Bonds or some hedge fund trader making a coupleof billion a year selling more, They just get caught up in the more is better, bigger is better, I'm better than you syndrome. I think a lot of this is because of all the media attencion, fancy magazines dvd's etc, Look at Noel Feather, Darner, Bonds Mcguire etc. They start too read their own press clippings. He was one hell of a hunter for many years until Remington tried to make him bigger than life, so they could sell a few more rifles. Its all a big game guys, look at all the fancy brochures and fancy dvd;s at your next hunting show.the mines bigger than yours syndrome. Do away with all the record books and a lot of this crap whould cease to exist. Do you think for a minute a lot of these safari club guys whould be such shooters if they couldn't see their names in some book. By the way I am a life member of most of the big organizations, just using safari club as an example.
 
I don't buy it. One day you're a "great hunter" and then wake up one morning and you're a POACHER? This is pure speculation on my part but I would just about bet that Darner was doing things illegal long before he got caught. For hell sakes, he got his wife involved. How pathetic is that. I hope they cut 'em off and feed them to him!

Gentlemen

This isn't the first time Darner has been caught poaching. He used to work for the Forest Service down in Chama, New Mexico and he was always out in the field finding huge bucks on there winter grounds well you guess the rest of the story.

Back in 1986 he leased a ranch right next to the one we leased just above Montrose, Colorado. There had been a huge buck spotted down on the winter grounds. Well Kurt went in and killed the buck and loaded it on a snowmoble and took off. There wasen't enough evidence to confict him.

And I can't remember the name of the taxidermist in the Grand Juction area, Kurt had found out that there was a 33+ mule deer in this shop and went and offered #3000.00 for the antlers. Which that point doesn't prove anything.

I believe their was also a story writin about him in Outdoor life about him being caught poaching and how his ex-wife is the one that turned him in, and Boone and Crocket removed all his deer out of the book!

Scratch - don't get upset. This topic just got hammered for a long time before you started posting. I don't think anybody is trying to put down your post. In a round about way I think Foreman was just saying that we've seen this topic before. ALOT!

Scratch, no need to apologize you just have to realize that all of us (including me) know everything about nothing! Hey, lets see if founder will start a betting forum on weather Darner will be exonerated or thrown into the slammer. My bet is that he will plead guilty to a misdemeanor charge and the DA and others will accept the plea since the evidence was taken by the state without an appropriate colored big game permit. yukyuk Here is 20 cents that Darner and his wife plead out to lesser charges and that their attorney will be the only one with a smile on his face. Cha Chang!!
 
The other smile might be on the face of the guy that gets his desert bighorn head back.
