It will be interesting to see how this plays out.

This could cause problems for the FBI. If that agent is found to have fired shots, a lot will depend on when he fired those shots. I have heard he fired the shots as Lavoy was getting out of the vehicle. If this is true, and that is a big if, and Lavoy had not reached under his jacket. That agent is in big trouble. Since he denied any shooting, if later he admits or is found to have fired shots, his credibility is crap if he states he fired due to Lavoy possibly reaching for a firearm.

If the above is found to be true, Lavoy would have possible justification to go for his gun and his death may be argued as being excessive force by law enforcement due to the actions of that one FBI agent. If that happens, Mrs. Lavoy will be a rich woman.

He may have been a threat, but if he was not an immediate threat, there is no need to shoot. If someone attempted to run me over, i move, chase him or her down, is it ok for me to then shoot them? No, I would be going to prison. Now if he was shot during the attempt, that's a different story, not after.

From what I understand, the FBI agent in question shot at but never hit. It was the state police who hit the mark. They have already been cleared by the prosecuting authority. Anxiously awaiting the details of the rest of the story.

I watched again the overhead video taken from the helicopter. Those first two shots were fired just as the Lavoy vehicle came to a stop in the snow bank on the left side of the road.
Now that the FBI agent has claimed he did not fire any shots, it will be almost impossible for him to claim later he fired the shots in a self defense scenario. A jury may see that those shots were excessive force on the part of the FBI and Lavoy only acted in self defense thinking he was going to be shot down no matter what he did.

This is going to backfire on the FBI and Mrs. Lavoy, and possibly others in that vehicle will be in line to win millions in a civil law suit. Just as Randy Weaver at Ruby Ridge won 2 million from the FBI over the FBI sniper killing his wife while she was holding a small child in her arms.

Lavoy was traveling at more than twice that speed. That in itself is more than enough to warrant a bullet to the head when you are barreling towards law enforcement who have already given you orders to exit the vehicle in the fist place.
