About a year ago I posted when the incident happened. At the time he escaped.

A Fortuna man accused of trying to kill a Fish and Wildlife warden by firing multiple shots at his patrol vehicle was ordered today to stand trial on all charges.

It looks like they will have to offer Wheeler a plea deal in order to get him to testify against the shooter since the text messages by wheeler can not be used against the shooter.
slap a charge of conspiracy to commit murder on an officer against Wheeler might get him to testify to shorten his time in prison. They should be able to use the text messages that wheeler sent against him as evidence to convict him of the crime. The case is stronger against wheeler then it is against the actual shooter, unless Wheeler agrees to testify.

Law enforcement has to love cell phones and social media like facebook. Idiot criminals.

You will be surprised how many times a suspect will lie as to his whereabouts when a crime occurred and their cell phone showed they were not where they said they were and showed them to be in the area of the crime at the time it went down.
