Man accused of sexually assaulting child released pending trial

TAOS, N.M.- A man accused of sexually assaulting a 13-year-old girl and two other children will be allowed to stay out of jail as he awaits trial.

In a Taos courtroom, prosecutors tried to make their case about why they believe Raymond Hernandez would be a danger to the community if he was released before trial.

"Your honor, this kind of conduct, these allegations have the appearance of brazen, compulsive sort of conduct almost doomed to be discovered under these circumstances, with so many people present in the house and yet according to these allegations the defendant did it nonetheless," the prosecutor told Judge Jeff McElroy.

Hernandez is accused of sexually assaulting his girlfriend's 13-year-old daughter at their Pe?asco home on January 12 after giving the teen and her friend shots of whiskey.

Hernandez was arrested but Judge Ernest Ortega released him on $10,000 bail with an ankle monitor.

Two days later, new accusations surfaced that alleged Hernandez had also raped a 19-month-old baby who lived in the same house.

Hernandez was arrested again and released on $20,000 dollar bail.

That same day, Hernandez was accused of raping a 6-year-old neighbor.

Charges in two of the cases have been dropped but are still under investigation.

Prosecutors say the alleged crimes were committed before Hernandez's first arrest.

In court, Hernandez's attorney argued that his client wasn't a danger to the community or a flight risk.

"Clearly, the allegations are not strong allegations. There's all kinds of conflicting statements and testimony, or conflicting statements anyway," the defense attorney said. "There's no criminal history, there's no signs of drug use, drug abuse. He's lived in this area his entire life. He's got his family in this area."

Hernandez's sister, Rachael Hernandez, testified that she has no concerns about letting her brother live with her and her 10 children in Questa while he awaits trial.

Judge McElroy then denied the prosecution's request to hold Hernandez pending trial and released Hernandez to his sister.

"I am concerned that there are children in the home. but these are children that he's had contact with his entire life and there's no allegations of any misconduct and that these children appear to be ? made statements to CYFD ? that they feel safe with him and that there appears to be adequate supervision of those children."

The judge also ordered Hernandez to avoid unsupervised contact with children and he must also wear a GPS monitor while under house arrest.

The thing I don't get is how they let these criminals out on bail. I see it on the news all the time where someone in NM commits a violent crime and judges will decide if they are ok to release and most of them get released because a liberal judge determines they're not a threat.
 
Sounds like the cases are super flimsy too. How would anyone know about the rape of a 19 month old baby?

I agree if he's guilty of what he's accused of they oughta burn him at the stake in the town square.

But also, false allegations of sexual misconduct occur all the time so just gotta wait and see what comes out at trial.
 
You mean like the guy who just shot his girlfriend here in Cruces, and was released on $2000 bond?! this state is a joke.

Wow that is some shitty thinking behind let that guy out that many times. That Judge needs to spend some time in lockup.

Now is the time to hold judges as accountable as the criminals they release (IN THESE CASES) pull his judgeship or post and publicly humiliate him/her for their non action.

NM judges have some crazy ideas nowadays.


ALBUQUERQUE, N.M. (KRQE) - The man accused of raping women at gunpoint has been released from jail.

Nicolas Williams was arrested last week on one count of rape. The 26-year-old is accused of picking up prostitutes on at least two occasions and raping them at gunpoint.

Thursday in court, prosecutors argued he was a threat to the community and should stay behind bars.

Instead, Judge Nan Nash ordered his release.
 
Lifelong NM guy, love this state....dispise the State Capital. Dems have run our great state into a ditch. Yes , we have elected a republican governor but NOTHING conservative moved forward as the Dems in the House and Senate stopped it. Sadly the idiots voting straight Blue are not visiting this website .
