Liz Cheney Wolf Legislation

I have a question:

If a state like WY has lost so much revenue from Wolves and Grizzles, why in the heck are they waiting for the federal government to bless a wolf and grizzly season? Procedures? Policy?

Why doesn't the state just open a resident only hunt for 100 grizzly tags and 100 wolf tags, make season dates, and issue the tags? I could see how a non-resident would have an issue taking the animal out of the state, but Who is Wyoming afraid of? Someone is worried that the federal government is going to sue the state of WY? Someone is worried that the federal government is going to pull federal money from the state? I'd argue that the state has lost more money over the past 15 years on game tags than all of the possible penalties that could be issued. Not to mention all of the legal fees that have been squandered and revenue lost from hunting tourism. Just do it. I'll assure you that the state of Texas has little regard for the federal government. F-em. Come invade us. We will handle the animals in our state. What the heck would a Trump administration do to any state that decides to manage their resources as they see fit? Nothing. Just do it. Law makers are lawyers, and With confusion comes opportunity. Law makers support the bar association with long, drawn out legal battles. I guess it would take a governor that just makes a stand, gathers a hardy group of state legislators, and just says F-it, we're doing this, and we can't wait another season. It takes balls.
 
LOL at that entire post of crc! Wolves in Wyoming are under the ESA (Endangered Species Act) as are grizzlies in the entire lower 48 states. Doing what you mentioned is ridiculous until they are removed from the Act and then the individual states still have to have a plan approved by the Feds before they are given control!

The federal and state governments don't follow or enforce some federal laws (immigration). Some states even write laws that contradict existing federal law (legalize marijuana). WY managing wolves would be no different.

Even if they did you have got to be kidding me if you don't think the Feds would not be on top of anyone found killing a wolf while it's under ESA protection! The penalties are so severe that anyone killing one other than the SSS method would have to be a moron!

Prescription for a sure fire way for Wyoming to never have an approved management plan.

Wyoming needs to stay the course, use the legal and legislative system's as designed. State control will happen, just not at the speed we would have wanted.
 
If they actually accomplish the delisting goal through legislation, I would like the Congress to tackle the ESA and EAJA statutes.

The ESA is particularly ripe for some change. In the ESA, I would like to see the venue changed for all litigation to the federal court in states where the particular listed animal is living. It would also be nice to increase the burden of proof needed to overturn a ruling of the USFWS with regard to the delisting of a species. It would also be nice to require the USFWS, at the time of listing a species, to set forth the exact factual criteria for delisting that species down the road. That would avoid the moving target system that we now seem to have in place. It would also be nice to require that the final adjudication of any challenge to the delisting of a species be fast tracked and completed within a year of the ruling by the USFWS.

I would favor eliminating the EAJA from applying in lawsuits involving the ESA. That would stop a lot of this litigation. The EAJA was not originally set up to promote "environmental" lawsuits.

HMMM seems to me that an Idaho Governor said something like.....We will not police or enforce any issues with Wolf violations when they were delisted then put back on. I don't remember one case where the Feds came to Idaho and slapped someone for killing a wolf. But then my memory is not what it used to be, or maybe everyone was compliant. Stay inline everyone.
