LaVoy Finicum was fatally shot by police in January 2016.

Last March, an investigation into the shooting found the fatal shots fired by Oregon State Police troopers were justified.

However, officials said they were still investigating the fact that FBI agents had fired two shots before Finicum left his vehicle. One shot missed the truck, and the other hit the truck's roof, according to Deschutes County Sheriff L. Shane Nelson.


"The question of who fired these shots has not been resolved," Greg Bretzing, the FBI's special agent in charge in Oregon, said at the time.

According to the federal indictment, Astarita was the one who fired those two shots. He then knowingly made false statements to three supervisors that he had not fired his weapon, the indictment says.

Astarita also engaged in misleading conduct by failing to tell Oregon State Police on two occasions that he had fired his weapon during the apprehension, according to the indictment.

He faces three charges of making false statements and two charges of obstruction of justice.

If that agent did in fact fire two shots before Lavoy left the vehicle and then lied about it. Indicates he tried to cover his butt after relizing he may not have had justification to fire those two shots while everyone was still in the vehicle. May be bad news for the FBI and I can see a possible lawsuit for excessive force. Unknown if Lavoy's family will win the lawsuit. Good chance if they can get a lawyer as good as Jerry Spencer who won a several million dollar lawsuit for Randy Weaver over the killing of Weaver's wife by a FBI sniper at Ruby Ridge.

So what if an agent shot a round or two. I think everyone in that truck is lucky the cops didn't send 50 their way. Armed or not, I think using deadly force on someone that uses a vehicle as a weapon is the right thing to do. The agent lying about it is wrong, but nothing that should be worth millions to anyone. You guys act like Lavoy had no control of the situation. He was dumb, but he was in control of his actions.

It has been a while since I saw the video of the Bundy vehicle being stopped. From what I remember was that the FBI agent was behind one of the roadblock vehicles and he ran out to his right possibly believing Bundy's vehicle was going to ram the vehicle he was behind. Instead the Bundy vehicle swerved to the left so as not to ram the roadblock vehicle and got stuck in the deep snow.

The agent would have been justified at the time the Bundy vehicle was heading towards him to fire at it, but it appears that the firing took place after the Bundy vehicle came to a complete stop and not a danger to the agents.

I am not a supporter of the Bundy faction and believe all of them should be in prison for the takeover they did in Oregon. I also believe that it appears a FBI agent panic and fired his weapon without real justification and then later lied about it after he calmed down and relized he screwed up.

Those two shots may have been the reason Lovoy got out of the vehicle and started yelling at the cops for them to go ahead and shoot him as he believed they were going to do that anyway. When he did reach for a possible gun under his coat, or in his pocket, those Oregon state troopers had every right to shoot him.

Federal law enforcement agencies are famous for not listening to local law enforcement for fear that the local agency will take the glory from them.

They did it at Wacko when the local sheriff told them that David Koresh made regular trips into town and could be arrested with little chance of resistance. Instead they surrounded the compound and we all know how that ended.

Same thing here, that other sheriff was willing to let the Bundy group come to him for a pow wow. The problem with that was if they did surrender to that sheriff, FBI lost the glory of making the arrest of the group leaders.

I do not buy the story the FBI gave out about their fear of Bundy group starting a firefight at the sheriff's office and innocent person's being in the line of fire.

Attorneys for the defendants accused of taking part in the Ammon Bundy-led takeover of a national wildlife refuge in Oregon have been seeking records from the investigation into the FBI's use of force in the Finicum shooting and whether there was a cover-up.

In a motion to keep reports sealed, Assistant U.S. Attorney Charles Gorder wrote Thursday that matters before a grand jury are protected from disclosure rules.

Oregon State Police troopers fired the rounds that killed Finicum during the Jan. 26 confrontation on a remote road, and the shooting was deemed to be justified.

Investigators, however, discovered FBI agents failed to disclose they fired two rounds that missed Finicum.

1911 is a little off on everything. lucky for Oregonians we have higher standards for hiring officers.




My first concern is that the OSP officers involved stay protected form the type of clowns we have on this forum. as far as I know exceptions are still in effect to keep their identity from the Bundy support terrorists but I don't know how trials can take place without exposing them . if you can't support these officers without getting threats what are their chances of ever leading a normal life again. just for doing their job correctly. # SAD.


If there was a cover up LO wouldn't have told us early on, this seems pretty elementary. queer ear's wife calling it a cover up shows she's as dumb as he was. but whatever it takes to keep their goobers hating America is what they'll do.

Dude you are still ignorant when it comes to coverups by the FBI. I do not think anyone here has a beef with what the OSP officers did. From everything I have seen and heard, those OSP officers WERE JUSTIFIED in their shooting of Lavoy.

If there is a coverup, it is about the 2 shots fired by the FBI agent and when he fired those 2 shots. Did he fire when the lavoy vehicle was heading in his direction, or did he fire the two shots after the vehicle came to a stop and the suspects were still inside the vehicle and may not have posed a danger to him.

I have problems with the federal attorney filing a case with the Grand Jury in order to prevent the full report being released to the defense attorneys which they are entitled to. I have seen the Feds do this before to cover up their screw-ups and prevent egg on their face and a successful lawsuit being filed against them.

If those two shots were fired at the Lavoy vehicle while it was stopped, did this action force Lavoy to exit the vehicle and do what he did in order to protect the other persons inside the vehicle including female occupants.
We will never know if that was the driving force on Lavoy's actions due to the fact he is dead and can not speak why he took the actions that he did.
