"Gianforte entered his guilty plea on June 12 and was fined $300 and ordered to pay $85 in court costs. He also was given a 6-month deferred sentence and ordered to perform community service, attend anger management counseling and appear at the Gallatin County Detention Center to be photographed and fingerprinted.

But Gianforte demurred from the latter part of his punishment. Just a few days later, his legal team filed a motion arguing that the county?s Justice Court does not have the authority to force him to be fingerprinted or photographed because, among other things, he was neither arrested nor charged with a felony."

"When asked whether he believed other Montanans cited for misdemeanor assault also shouldn't be fingerprinted and photographed, he walked into his office without comment."

This guy is going to fit in well with this administration.

BTW, Ex Republican House Speaker Dennis Hastert was released from jail today. Keep you kids inside folks, well at least keep your sons inside.

Why hell, lets all reflect on How Obama & dems gave classified information to a Weiner and he was so happy about it that he just had to show his to our kids! Then to add fuel to the fire they insisted on states allowing access to our kids in our restrooms and in the showers by folks that are confused or could just want to stoke their weiners.

I'm kind of surprised you coming from Ca. and all didn't cut the guy more slack. He probably got confused on his party affiliation and was acting out his right to be a democratic activist. After all that's allowable behavior in your playbook isn't it, so why hold this guy accountable.....for something your party been doing for years.....is it because he didn't wear a mask?

"In a formal motion filed after the hearing, defense attorneys Bill Mercer of Billings and Todd Whipple of Bozeman argued that state law doesn't give Justice Court judges discretion to order fingerprints or photographs of defendants.

While state law does allow a judge to order photographs and fingerprints of defendants charged with felonies or defendants who have been arrested for most misdemeanor offenses, neither was the case for Gianforte.

?Mr. Gianforte?s prosecution does not fall within the narrow group of prosecutions for which courts have the authority to order fingerprinting and photographing,? the defense motion read.

In Lambert's reply filed Thursday, he asked that Gianforte?s motion be denied, arguing that Gianforte?s attorneys erroneously interpreted Montana law in their motion.

State law does give Justice Court judges the authority to order that a defendant like Gianforte be photographed and fingerprinted, Lambert said."
