The Promise - The Reality

Obama had a very skinny goose in the ACA. He knew he had to fatten her up or she would die. He used EO's to feed her up and give his people more of my money. Trump decided to take food away from Obama's goose so it would die of starvation and save me some money. All good.

That is the talking Yam's narrative but it is not fact based. Spend even 30 seconds reviewing what happened and you will realize once again you have been lied to by the human tanning bed. Remember he was going to repeal and replace it on day one, he said he would make a deal because that was his talent. Where is the beautiful deal? or is being conned and lied to enough for you?

The Legal Background

In fact, the ACA requires the federal government to reimburse insurers for these reductions. This is not a bailout. It is rather a statutory obligation of the federal government to pay insurers for services they have provided as required by law. In 2014, the House of Representatives sued the Obama administration in House v. Burwell (now House v. Price) claiming that the cost-sharing reduction (CSR) payments to insurers had never been appropriated by Congress and were thus illegal. A district court judge accepted this argument in the spring of 2016 and enjoined their payment, as President Trump?s statement says, but stayed her order pending appeal. The Obama administration appealed, arguing that there was in fact an appropriation. Until yesterday, the Trump administration had not taken a position on whether there was an appropriation or not.

The appeal is still pending, with the House and the Trump administration having agreed to stay the appeal several times. At the end of August, the D.C. Circuit Court of Appeals allowed 19 state attorneys general to intervene to protect their citizens. For more on the CSR backstory see here and here; for more on the intervention, see here; and for Health Affairs Blog posts on cost-sharing reduction payments, see here.

Change the law if you don't agree or like it but to unilaterally end this is going to cause real harm to real people and most of those real people vote. Also most of them are within Trump's base so it is going to be interesting to watch.

LAST EDITED ON Oct-13-17 AT 03:10PM (MST)[p] I agree totally.

Since Trump could not deliver on his promise he has an obligation to make the existing plan work the best he can. taking a dump on it is not fixing it. one thing that cannot be denied, as of today it's officially 100% Trumpcare . he owns it outright.

Can someone explain how cutting funding for insurance will save any money? well, I mean if the uninsured don't just go off and die in a ditch that is. we all know that's the goal, but it's not going to be the reality. we pay either way.

So, he knew idiots like McCain and the two bitches would never allow him to win this one. He took action that will starve the beast quickly and force congress to actually do something. You should be smart enough to get the drift. Just like DACA. He blew it up and forced congress to do something. If they can't get it done the 800000 will go bye bye. How did those poor people survive before the ACA? You know they weren't dying in the streets.

So your plan is to have medical providers eat the unpaid bills ? what happens when they all go broke? socialized medicine? maybe , Trump says he'd like that.

Bill have to be paid by someone. we can't all be Stoney. so let's be big kids here and admit that much.

Trump already said he would provide protection for DACA kids if congress failed. funding for medical care will come as well. you're smoking crack if you think this hard line doesn't have a velvet backing.

All we're really seeing here is Trump's total lack of leadership on full display. he's clueless so he kicks it down to some buffoons who are as clueless as he is. these clowns have been working on this for 8 years and have NOTHING to show for it.

If the democrats weren't such timid weak losers they'd stick a hose in Trump and the GOP's mouths and drown them right this moment. our nation is going to hell and they sit on their thumbs and try to do this like gentlemen. if Karl Rove were a democrat politics in the US would never be the same again. there would be blood and this chit would be over.

No, the bills don't have to be paid and the DACA kids don't have a right to stay here. Congress will never do anything big again unless they are forced to. If they vote for or against something big they will be held accountable. They don't like that. The courts ruled that Obama had no right to give the insurance companies the billions to make his ACA cover more people. Congress has to appropriate the funds.

Surely you don't think these funds can be cut of and rates won't go up? is that what FAUX is telling you?

So you're saying a private funded subsidy is better than a tax based subsidy. I can see where the Koch brothers might go for that, I'm not so sure for the rest of us .

This will effect Trump voters the most statistically. this is where the dems make like republicans, lots of promises and do nothing. 2018 is only a year away.

Of course they will go up. That is the point. Get rid of the subsidies and congress will be forced to pass something. You sound like Bernie. Wanting to give everyone free everything but never address how it will be paid for.

Are you saying the republicans are more than willing to fund this they just want to cross the T's and dot the i's so it's all legal like ? that's not how I understand it.

What funding plan could republicans agree on that will leave them able to say they fixed it ?

They could do a comprehensive overhaul but McCain decided his ego was more important than the people who voted him in. That bill was just a start to reform.

So there is plenty of money available, we just need to play the nutshell game again ?

Oh my, I was under the impression some people don't want to pay taxes for poor people's healthcare and were looking for an out. boy do I feel silly now.
