Ok Not really. But if this deer were to get poached what should be the punishment for that poacher?

I'm guessing Tri will be able to take you guys at least above 100 posts on this one.

If this deer is poached it's larceny since he is high fenced probably Texas and he is privately owned. It the same as stealing a car although his value may be more than some cars. Good Luck on your quest toward 100 or 200.

To answer your question, the punishment should be whatever the punishment is for walking into someone's pasture and shooting their cow.

Because his straw value is a # his insurance company used to determine the value of that farm animal.
 
This isn't a discussion about what he is worth. This is a discussion for each of you as INDIVIDUALS, not a pack, to express what you think the poacher's punishment should be.
 
Now that we have a few names out there I'll say the fine for poaching this buck should be $14 and 2 minutes of community service.
 
18k geez u throw the Texas jail time on top of that from the law they past back in 99 that's a real deterrent!

He cannot be poached. Only stolen. Therefore the same punishment as would be handed down for some similarly VALUED privately owned asset. Tri, if you are trying to draw a comparison between this buck and the Hyde Park buck its apples and oranges. One is personal property and one is state property and assigning a value to the latter is much harder. An economist could come up with a value but the lay person would only be guessing. What is it, 12:25pm in Texas? You missed lunch. So you have a few hours to find an economist to have dinner with that could give you an idea. Or are you one of those too?

I am not trying to figure out what the states say. I want to see what each member believes the punishment should be. Everybody seemed so eager to state what the punishment should be for the Hyde Park Poachers, why not now?

You couldn't be more wrong. First if it is shot on his land that is still poaching and second it is still property of the state of Texas, not the landowner.
 
My bad. I am not from Texas. So I do not know the laws regarding game on privately held game ranches. I assumed it might be like a farm where the animals are personal property. Thank you for correcting me. So that must mean the State has management control over that buck? And the general populous can hunt it if it squeezes between those wires? Or if the general public trespasses and climbs the fence and shoots it at night with a 22? Then I suppose an argument could be made in court that the punishment should be similar.

And for the record I have never said what punishment should be handed down to the poachers in Utah. That's the judges job. I can admit I am not one. (hurry go back and read and see if I recommended a punishment)

In Texas are hi fence hunting operations and game farms (where they've bought and sold and can ship) considered the same thing under the law as far as who owns the animals? Sorry to sidetrack just curious
 
In Texas State Game animals, which includes Whitetail and Mule Deer, which are under high fence and even within a licensed breeding program still belong to the state of Texas. Exotic species are considered property of the land owner in which they reside. Right now there is a big war between the deer breeders and TPWD for ownership of deer that are in licensed breeding facilities. To give you an idea how crazy it can get there are actually people using deer here as collateral for bank loans when by law they don't even own the deer. Rap your head around that one. :D
