Taulman/USO saga is over......hopefully

H.R.1268 passed the senate yesterday which contained as an amendment,senate bill 339 which reestablished a state's right to manage it's wildlife as it sees fit (specifically mentions and negates the commerce clause effect on state wildlife). This effectively nulifies the 9th circuit court ruling. Personally, I see it as a victory for all hunters and the states.


President Bush is expected to sign it in to law by Friday.
 
wonder what the scrawny little ex-pharmacist will do now? maybe he can get his toady griz to hold him and make it all better. this probably ain't over, but at least i think there is a little light at the end of the tunnel. i hope in taulman's case that the light is a big fast train and in our case it's good daylight from a new day. just goes to show you how much muscle the majority has. taulman thought he was taking on the guys on the azgfd commission. he didn't plan on taking on every true sportsman this side o' the missouri. congratulations to reid. i really dislike his liberal stand on most things, but he's done us a good turn here. maybe if the azgfd woulda got the guys with some backbone involved to start with this woulda been over years ago. whatever, this is good news. maybe i can have a chance at getting me an Az. sheeptag now.
 
I put out a great big THANK YOU to HARRY REID from Nevada. If it wasn't for him and his great influence as Senate Minority Leader and the fact that he is from the west and understands game management this might not have ever occurred. The party that he belongs to doesn't matter in this case. He did what was right.

The bill goes into effect the minute the president signs the bill.

The Nevada Wildlife Commission meets this weekend, any bets on if Taulman shows up to the meeting to give the Commissioners a Big Congratulations on winning the fight.

Good job to all who wrote letters and made phone calls. Wonder what kind of letter full of bull old George will be writing to his sucker list now? The guy really hurt the hunting community but he also galvanized a bunch of people who are now very pi$$ed off. It will be interesting to see how each state treats USO after the new law takes effect. Dubya better sign this one.

A big thanks to those that took on this battle. I think it shows what the power of unity can accomplish. I am sorry I did not make the time to get involved but truly appreciate the time and labor of those who did.

Assuming Pres Bush signs the bill, what kind of guarantee do we have that AZ G&F will do anything about it and modify things accordingly?

Not that I dont trust the G&F, but I dont think they always act in the our best interests.

Regardless, some justice seems like it is being served and hopefully GT and his cronies feel the pain.

Best of luck on the draws. I can only apply for BPs this year cause of a luxury cruise I have planned to the middle east, so I am one less to compete with on the draws.

Funny thing is, most western states are celebrating cause they can maintain Resident opportunity, and my State (CO) is always looking for ways to take mine away.
 
hopefully uso will go out of business now that they got whe west all messed up. greed takes over fairness again.i apply all over the west but whats fair is fair non. residents shouldnt have an equal shot at the tags.
 
The president signed the Reid bill today in the oval office so the bill has finally passed. The bill was approved by one of the largest margians of any legislation passed in quite a while. It recieved bipartisan support from the moment it was initiated. Congratulations to all of you that assisted with the passage of this bill. Congratulations to all the residents and nonresidents that offered your support of this important piece of legislation.
 
I certainly hope not. It would be a shame if something like that befell such a forthright, upstanding, honest individual as George.
 
It's great news that the bill passed, but what does this mean for Arizona & Nevada THIS YEAR? Will anything change for the 2005 fall draws or is it already to late to go back to normal and we'll have to wait until next year?
 
I don't know about AZ but the fellows over on Bowsite are saying that AZ is going back to 10% cap this year. However, they are saying the actual number is 13.8% according the AZ G&F. There is a meeting on the 14th to set the exact numbers.

I'm just passing along what I heard so take it for what it is worth.
 
As far as I know Arizona is keeping with the one pot draw. But now that the bill is signed who knows. The court ruling for Arizona was lost in part because they could not justify their cap.

Nevada is meeting the 14th (saturday) to set quotas. The non resident distribrution of tags will be 13.88%.

A couple of nights ago I heard Tommy Ford (NV Wildlife Commission Chair) tell a group of people that the new Nevada quota policy would still be in place despite the Reid bill. Since the policy was set as part of normal rule making process, it can't be changed outside that process which would take a year or longer. I got the impression that the commissioners like the new policy better than the old one anyway and they would not be inclined to change it unless pushed by the public.

2005 NR quota is something like 13.8% based on a formula that could change the quota every year.
 
I would assume that since AZ and NV already are taking apps that they would have to stay with the agreed on quota. Just a thought.

Who cares? The bastage knows now that we mean business now. He already has a bad reputation w/ most of the hunters in the west, it will only be a matter of time before we take him down for good. What a greedy, pathetic, LOSER!
 
The NR caps can't be changed without state approval. We are under a court injunction that must be followed. There will be no res or nonres caps on Bull Elk and Deer north of the Colorado river per AZ G & F for this years drawing. The earliest they could be implemented would be 2006 and that takes legislative approval. The matter is being reviewed currently by legal representatives.
I think you'll find that the amount allocated with the caps next year, will be more fair. Good luck to all of you that applied for our drawing. And thanks again to all of you that helped support this bill. Gil as stated on that other site they were just speculating what they thought might/could happen. Nobody knew for sure until we got this.
 
I think I'm happy...........but these kinds of rushed bills always have unintended consequences. I haven't read the bill and wouldn't understand it if I did but it makes me nervous.

Don't be shy to email USO your thoughts. I'm sure they need a sympathetic letter in this time of need. I wonder how much there lawsuits cost them?

The suit here was a freebie. He sued for legal fees and that damn judge gave him the nod. I think it was over $200000 which came right out of game management and caused the big price hikes.
 
An e-mail from an AZ G&F official on bowsite was posted and was as stated above. No cap for '05 for bull elk and antlered deer north Kaibab. It will be evaluted and any changes will be in 2006. They still have to appeal the 9th circuit ruling to get the injunction removed which is a mere formality but still must be done.
 
This is great news for all states. Thanks to AZ and NV and everyone that fought for this. ND had a lawsuit filed against them by MN saying the limiting of non-resident hunters was unconstitutional and blah blah blah......this should put the kabosh on that as well!
I think it's only fair that each state should manage their own as they see fit and that residents should get some preference over non-residents.

I hope this means the kibosh to anti hunting type legislation on the federal level. Anti hunting groups went after bear baiting on all federal land but it was narrowly defeated last year.
 
Idahoelk, I wish that were the case but this probably won't help as much in that regard. But it will protect the states Game & Fish Departments in quite a few ways. We're going to have a couple of bigger battles confroning us on the horizon in that regard. We will all need to work together when the time comes to preserve hunting.
 
I don't see it changing anything in favor of residents or fees!
If anything its going to hurt some states because now the FED's money,US wildlife money is at discresion of the feds! If the states faulters at all no fed money.
State still be wide open to law suits about fees or anything else that feel bias,raceist,or just wrong(non res tag numbers!is a good case). State law is still an a state law and rules will not change as we go along and from now on EVERTHING will go sllooowwwweeeeerrr in AZ when it comes to an issue of big ga\me hunting!
So be happy AZ!(see what happens! I say nothing for now!).
The cost of hunting in AZ is now going to climb yet higher for everyone!(recoup law suit funds, build future law suit slush fund ).

Rackmaster-maybe you can translate that a bit more. The feds could never tell the states how much to charge for tags so no point there. With the new law the states can freely discriminate in favor of residents. Doesn't mean they won't give more tags to NR than before. As for federal dollars I have no idea what your point is as the only dollars for game management come from the PR act and it's counterpart for fishing supplies. And finally anyone can sue for anything in this country. The new law just makes it a whole lot more of a financial risk if the plaintiff loses and has to pay the state's legal fees. Works both ways on that issue.
