There are a couple of reasons they could declare a mistrial, so I just lumped them together.

CPR is not used for choking, Heimlick maneuver is used for choking. Rittenhouse is innocent for not lifting a finger.:)

Actually CPR starts out with tilting the head and checking for breathing and airway obstructions if the person isn't breathing. Then if something is found you can do Heimlich or clear the obstruction if found with a finger sweep.. now if they are standing and using the symbol of choking that is different. If no obstruction it may require CPR. Emergency breathing has been phased out. But you know this. I taught CPR/ First Aid for years. I hope I articulated this enough but I'm not overly fond of making long posts. Too many typos.

A verdict is never "innocent"...it is "not guilty". It is the prosecutors job to provide a burden of proof that the defendant is guilty beyond a reasonable doubt. In this case, the only one guilty of anything is the prosecutor being an incompetent imbecile and not knowing that the more questions he asks trying to get the desired answer makes the defendant look more "not guilty".

If you follow the letter of the law he is not guilty but I think it will be a hung jury. The prosecutor should be fired for misconduct.
 
After this morning's news I am changing my vote to a Mistrial. The judge is not going to rule on a mistrial until after the verdict is read. CAN YOU IMAGINE what will happen if the verdict is guilty and then he responds with a mistrial? The whole country will burn to the ground..
 
Any way this plays out is going to cause uproar. A mistrial means another trial....so go through this all over again. Another chance for the prosecution to correct mistakes made and make the defendant look worse. They definitely won't have the same DA prosecute if there's another trial. If found not guilty this time around, riots. I wish we could go back to when people would accept things for what they are and not feel they need to hurt people or property to get a point across.

Not over guilt or innocence, but over what to charge him to save their city from burning to the ground in and fear for their own safety, for not making the preferred progressive "right choice" - If they looked at the evidence, and they did... it's a no brainer, self defense, not guilty as told by the evidence and their own states witnesses. They painted him as an active shooter. Never heard of an active shooter who roams around all night not shooting anyone until 3 psychopathic criminals chase, corner and attack him.

I guess that's why they call it jury nullification. You never know what they will do. It doesn't help that they can hear the crowd outside. That should be against the law, but then maybe that's by design.

But then, like the owner says, I got a buck this year so why should I care??
 
I will tell you how off the wall a jury member can get. I arrested a guy for burglary where the home owner chased the guy out of his house at 1:00 A.M.
After getting a lead on the suspect, served search warrant on suspect's home and found the victim's stolen property. Suspect's girlfriend admitted that the night of the burglary boyfriend came into their apartment after 1:00 A.M. out of breath and carrying the stolen items.
On jury trial one female member would not vote guilty. Jury foreman got her to admit that she felt he was guilty of the crime, but looked so much like her own son, it would hurt her feelings to convict him. I never trust a jury to come to the right decision due to the human element involved with emotions or fear, or just outright idiots on the jury.

The first time my wife got picked for jury duty was a rape case. I was the investigation officer on that case. Needless to say, the judge who knew my wife, stated to her, i do not think we can allow you to set in judgement of your husband's testimony. She got booted off.

You can tell them that your FIL is the chief, but they still make you sit there so the lawyers can reject you.

But since they seem to want the dumbest people sitting on juries, they fill up pretty quick around here.?

That must be why I always get picked. I was on a 8 week murder trial years ago. I'll never forget it. We deliberated 2 hours. Guilty. He got 25 to life. I did a search for him a couple years ago and he's still in prison. He was in trouble for making Pruno and was in solitary confinement when I looked.

I'm out of the jury pool now.
 
They should've taken this "article" much further....they just scratched the surface. Maybe for fear of backlash?
