LAST EDITED ON Jan-25-13 AT 11:03AM (MST)[p]A big thank you to our state senate for introducing SB 1112 which makes it a class 6 felony to enforce any federal law or order that restricts magazine capacity or ammunition type or bans any semi-automatic weapon within the state. It also makes it illegal for any judge, legislator or juror to try to enforce the same and authorizes the Attorney General to defend citizens of the state against any actions in court.

Supremacy Clause applies only if Congress is acting pursuant to its constitutionally authorized powers. The Supreme Court would need to decide the validity of the proposed state law. So far, WY and TX have also introduced similar legislation and I hope other states will join.

Still being litigated. Hage v. United States will probably be heard by the Supreme Court.

No need. Federal jurisdiction is limited to national banks and members of the Federal Reserve. A bank doing business exclusively in AZ and not a member of the federal reserve is not involved in interstate commerce therefore the federal LEO wouldn't get involved, and if he did a good defense attorney would win the case since an arrest, or evidence collected, by the fed's would be tainted.

Nevertheless, a state could pass a law and the validity would be judged by the Supreme Court.

That is really the issue with the proposed legislation. Get a law on the books that challenges any federal law that may be enacted contrary to the second amendment, let the Supreme Court enforce the Constitution and add state resources to the private sector resources to bring the case forward.
 
Sorry you are wrong. A federal officer whether it is FBI or Border patrol can arrest any one for a state crime without any concern. They have the same powers of arrest a city cop would have. So you think that if an FBI agent arrested someone for murder a lawyer could get them off? Nonsense
