Some proposed legislation that would put a real damper on all the ESA lawsuits from the eco-elites. Take the money out of process and a lot of these environmental lawsuits that involve timber harvests, grizzly bears, sage hens and wolves would come to a stop.

In the last Wyoming wolf case, the Federal District Judge Amy Berman Jackson in the D.C. District relisted the wolf and took them from state control. The decision was not well thought out and was ultimately tossed by the D.C. Circuit Court of Appeals. Should the eco-elites be paid their attorney fees for winning the skirmish and losing the war? This is why the EAJA has to go.


From my experience as a lawyer, an environmental attorney may charge the various eco-elite groups they represent around $ 200 to $ 300 an hour for their work regardless of the actual outcome. However, if they win their eco-elite lawsuits, they may charge the government more than that under the EAJA.


Will the legislation pass, probably not. Does it show you how real money is involved in this process.
