This case demonstrates what the real problem is with the ESA. Because of the EAJA, these eco-elite groups receive costs and attorneys fees from the federal government when they successfully argue a case under the ESA. Obama appointee, courtesy of Max Baucus. He is a darling of the eco-elite groups who forum shop for him when they want a favorable decision.
These lawsuits are a cash cow for these groups and greedy environmental attorneys. These groups and their attorneys don’t care about the animals or the people whose lives are ended or destroyed by these animals. Look at the dollars involved. Until the EAJA is amended to delete any awards under the ESA, this will insure lawsuit after lawsuit under the ESA. Kill the funding and you will kill the beast. Just sayin...my
