Legal spike in Utah?

Is this a legal spike in Utah? He has three points on his right side but they are all below the ear.

Do you have any better pics? Looks to me like a main beam with 2 brows = legal spike

I would need better pics to confirm.
I have better video. The pictures are screen shots from the video. It is a main beam with two brow tines. The main beam goes flat, not up like the left side.
 
Can't tell from the pics, but here is the official definition:

"Spike bull" means a bull elk which has at least one antler beam with no branching above the ears. Branched means a projection on an antler longer than one inch, measured from its base to its tip.
